Default Unfrickinbelievable

What a day I have had today. Some 900 year old giffer in a Toyota Starlet thought it would be good to drive into the back of my car. I was reversing off of a mates street at a reasonable pace and the old giffer came round the corner and drove straight into the passenger side corner of my back bumper. He then had the cheek to get out of the car and blame me for driving into him, he at first refused to provide insurance details and got mouthy and tried squaring up to me which just made me laff. He eventually provided the details and continued to blame me for the collision. I pointed out that it is pretty hard to miss 2 big reverse lights on the back of my car and given his age I asked if he was required to wear glasses when driving and he refused to answer. His number plate is cracked and a few scratches on the front bumper and he said can we not just pay for our own cars to be repaired. I said no way, he was ranting on that he would lose his no claims etc but I just said tough, so know I'm left with a smashed back bumper. I do have 2 independant witnesses to the accident who have said they saw him drive straight into me. I can only asume because I was reversing in line with the kurb that he thought my car was stationery.

I have only just had the back bumper repaired after it was nicked a while ago and again same thing.

Gutting Dave But from the above that sounds pretty nailed on that he thought it was his fault.

Good to hear you have witnesses as unfortunately in this day and age nobody seems to want to take responsibility for accidents. I came within about an inch of having my back end taken off whilst slowly reversing the other week by some pillock going the wrong way on a one-way system - even though he missed I was fuming for hours.

I'd like to see a picture of him squaring up to you

It was funny he was about 5ft 6 and at least 60 years old. I said just think about it before you do anything stupid! My girlfriend couldn't believe what she was seeing. Daft old sod!

Sorry to hear this Dave Would have enjoyed seeing him squaring up though, you aren't exactly diminutive

One note of caution however. The DSA guidelines and the highway code state that you should not reverse from a minor street into a major, or from any side offshoot into a road. When you are reversing it is your responsibility to observe effectively and take suitable precautions for the safety of other road users. During a reverse if approached by another vehicle you are duty bound to stop and make the car safe until it is safe to proceed after the other vehicle has left, or indicated that they wish you to complete your move and have given you priority. If it gets arsey you should double-check the legal standpoint. Only pointing this out in case, but lets hope the clueless old git just accepts responsibility.

Crap mate.

You do have to be careful he doesn't win on default, i'm pretty sure, i'm not kidding, it's illegal to reverse on to a main road, not silly side roads, but a main route.

Nearly had a similar thing, my old RS2000 wouldn't start when leaving a mates one night, and just before i did the Basil Faulty thing and start hitting it with a branch my mate came out, no good it wasn't having any of it, he said he'd give me a lift home. We decided we'd stick the car down a side road, off the main road where it was parked. So we pushed it along and then turned it across the road, so we could push it backwards down this side street. No sooner had we stepped off the the main road an Ambulance came screaming down the main road, all we could do was laugh, had it been 5 seconds earlier we'd have needed the flippin' thing......



Car started first time following morning

be carefull as swen6 says as far as i know (please correct me if im wrong ) it is illegal to reverse onto a main road good luck (he who strike first is a ******* but usually wins)

Well its in the hand of the insurance company now so we will see what happens from there. I rung him again last night to confirm some further details with him and he continued to be a complete and utter a@@e. I told the insurance company about him refusing his details several times and discussed the accident and my insurance are confident that he has no leg to stand on! Basically they said whether I was moving or stationery he has gone into the back of me so instantly liability is on him. Just have to see what happens. I have 2 independant witnesses anyway.
